In this article we discuss the discursive functioning involved in the edition of Precedent 610-STF. Although it has no binding effect, this Precedent has governed decisions in different Brazilian courts since then. Continuing a discussion on the inadequacy of its normative content, proposed by Moreira et al. (2019), in this article, we ask ourselves about the conditions of enunciability that guaranteed its emergence and its consolidation. To this end, we proceed to the analysis of the enunciative scene involved in / by the texts that underlie the five HCs that substantiate the edition of the epigraphed Precedent, based on a discursive-ergological approach. Questioning the statements in the context of work of criminal justice, we find an enunciative scene in which the values of two legal assets are confronted: life and heritage. The discursive functioning that establishes this confrontation points to a structuring feature of the legal system that, aligned with capitalist rationalities, associates the right to life with the right to property.
