Abstract
SANTANA RAMOS, Emilia Mª. Cultural imperatives as guarantee for immigrants’ rights. Rev. Fac. Der. [online]. 2016, n.41, pp.287-311. ISSN 0797-8316. https://doi.org/10.22187/rfd2016212.
This paper studies the guarantee levels that enable immigrants to express themselves freely on any topic, on their beliefs, and in general, it assesses whether immigrants, as such, are able to act according to the identity provided by the culture into which they were born and which has shaped their personalities. The premise argued herein is that this role of cultural identity in the process of construction of immigrants’ personality is part of the right to freedom acknowledged by natural law. To that effect, the construction process of individual personality by means of the identity culture is predicable of each culture and individual, of any immigrant in any culture, and is not restricted solely to immigrant cultures, any immigrant in any culture. Thus, conscious or uncounscious obstruction of the identity culture of immigrant communities by host societies, generally becomes the main insuperable obstacle for such communities, limiting and hindering their path towards their own cultural determination.
